Employment

Are you re-organising the structure of your business?
If so, there may be redundancy and unfair dismissal implications.

Do you have a problem employee?
We can advise you on how best to resolve the difficulties with the minimum disruption to the rest of your staff and the smooth running of your business.

We can prepare Contracts of Employment, advise you on disciplinary and grievance procedures and, if necessary, liase on your behalf with ACAS.

Because we also have extensive experience in representing employees, we are able to include the employee perspective in the advice we give to you as an employer.

Employment legislation is becoming an increasingly complicated area of law and a failure to follow procedures at an early stage can be both prejudicial and costly later. We aim to provide comprehensive advice on all aspects of employment issues.

It is now a statutory obligation on most employers to provide a contract of employment to their employees including the main terms of the employment relationship and specific regulations required by statute. In addition it is considered good practice to have user friendly and anti discrimination policies available to your employees. We will spend time understanding your business and its aims and then draft the appropriate documents using plain language to suit your requirements, provide a fair relationship between your business and its employees and comply with current domestic and European regulations. Of particular importance is to draft the contract of employment so as to protect your business should senior staff leave you with a view to joining a competitor.

Should you need to dismiss or make redundant one or more employees we can advise you on how to conduct the process fairly, thus minimising the risk of former employees making a successful employment tribunal claim against you.

Should a tribunal claim be made against you we will work with you to resolve the claim as quickly and effectively as possible. We will provide you with an analysis of the strength of your case in relation to each issue involved and the likely cost involvied enabling you to make an informed decision as to whether to seek a negotiated settlement or defend the claim at tribunal.

The legal aspects of running a business are a “minefield” waiting to catch employers out. At Browning's we try to ensure that your business is well informed and has appropriate systems and documentation, all of which create peace of mind.
